Welcome to The Tropical Punch. These Terms of Service ("Terms") govern your use of thetropicalpunch.com (the "Site") and any purchase you make through it. By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who We Are

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase through the Site.

3. Products and Orders

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including orders that appear fraudulent, are placed in error, or involve pricing or listing mistakes. Product images are for illustration and may differ slightly from the item delivered. We may discontinue or modify products at any time without notice.

4. Pricing and Payment

All prices are listed in US dollars and are subject to change without notice. The price charged is the price displayed at checkout at the time of your order. Applicable taxes and shipping charges are added at checkout. Payment is due in full at the time of purchase through the payment methods offered on the Site. By submitting payment information, you represent that you are authorized to use the payment method provided.

5. Shipping and Delivery

Shipping timelines shown at checkout are estimates and not guarantees. Risk of loss passes to you upon our delivery of the order to the carrier. We are not responsible for delays caused by carriers, weather, or events outside our control. 

6. Returns and Refunds

Items purchased may be returned for a full refund or store credit within 7 days of purchase. Swimwear can be exchanged or you can receive store credit within 7 days of purchase. Returned items must be in their original condition—unworn, unwashed, and with all tags attached and intact. Items not meeting these conditions may not be eligible for a refund. 

*Tropical Punch reserves the right to reduce or refuse refunds or return products back to customers where the return conditions are not met. 

Bath, body, incense, candles, food items, pajamas and jewelry are final sale.

This includes specialty items that might be marked final sale.

7. Intellectual Property

All content on the Site, including text, graphics, logos, product names, images, and design, is the property of The Tropical Punch or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.

8. Acceptable Use

You agree not to use the Site for any unlawful purpose, to interfere with its operation, to attempt unauthorized access to any systems or data, or to scrape or harvest content or personal information from it.

9. Third-Party Links

The Site may contain links to third-party websites or services. We do not control and are not responsible for their content, policies, or practices.

The Site and all products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not permitted by law.

11. Limitation of Liability

To the fullest extent permitted by law, The Tropical Punch will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

You agree to indemnify and hold harmless The Tropical Punch and its owners, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Site.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of CA, without regard to conflict of law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in San Diego, CA, and you consent to their jurisdiction. 

14. Changes to These Terms

We may update these Terms from time to time. The version posted on the Site at the time of your order applies to that order. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
